Sanitary and Phytosanitary Barriers
Upon withdrawal from the EU, the UK transposed existing EU sanitary and phytosanitary (SPS) measures
into UK law in 2021, thus creating close initial alignment between UK and EU SPS measures. Some trade
concerns outlined in the SPS section of the EU Chapter in this National Trade Estimate Report therefore
remain with respect to the UK. The United States is concerned that these measures may unnecessarily
restrict trade without furthering safety objectives, because they appear to be applied beyond the extent
necessary to protect human, animal, or plant life or health, not based on science, or maintained without
sufficient scientific evidence. Specifically, the UK remains closely aligned to EU policy on pesticide
approvals, regulation, and maximum residue limits (MRLs). However, there have been divergences
between the two regimes as changes to some EU SPS measures have not been automatically reflected in
the UK SPS measures (with the exception of Northern Ireland) and vice versa.
